MEDICAL LEAVE CAN’T BE A GROUND OF DISMISSAL-----
A PSU BANK officer scale-2 is dismissed on a/c of long absence (8 months) from bank despite his submission of medical fitness & unfitness certificate from Govt dept , more over without responding the medical (sick leave)leave application bank issued charge sheet & inquiry officer proved the charge sheet which caused the dismissal of CSO , now we have to judge action of bank on the ground of legality ----
NOTE --The enquiring CSO has asked me to explain him in "hindi" but I am using mix language for the benefits of all friends --------

Can bank reject a medical certificate dully issued by a regd medical practitioner ?

23. Officer or employee to be absent from duty without permission or be late in attendance. - (1) An officer or employee shall not absent himself from his duties without having obtained the permission of the Competent Authority, nor shall be absent himself in case of sickness or accident without submitting a proper medical certificate from a medical practitioner acceptable to the Bank.
& FURTHER SPECIFIED THAT---
Any officer or employee desirous of resuming duty on expiry or medical leave shall produce medical certificate issued by a recognized medical practitioner acceptable of the Bank stating that he is fit for duty.
MEDICAL LEAVE IN PSU BANKS
34. Sick Leave:
34.(1) On and from 1.1.89, an officer shall be eligible for 30 days of sick leave for each completed year of service subject to a maximum of 18 months during the entire service. Such leave can be accumulated up to 540 days during the entire service and may be availed of only on production of medical certificate by a medical practitioner acceptable to the bank or at the bank's discretion nominated by it at its cost.
SIMILAR RULE--
It is clear that medical leave rules are similar in all banks may be availed of only on production of medical certificate by a medical practitioner acceptable to the bank or at the bank's discretion nominated by it at its cost.
WHAT IS A MEDICAL CERTIFICATE & ISSUING AUTHORITY ?
Indian Medical Council (Professional Conduct, Etiquette and Ethics), Regulations, 2002 मे साफ है कि कौन मेडिकल प्रमाण पत्र जारी करेगा तदनुसार -------
a medical practitioner can issue a medical certificate after a patient has taken sick leave, providing the certificate states:
• the date the certificate was issued
• the period during which the practitioner believes the patient would have been unfit for work.
उपरोक्तानुसार यदि बेंक अधिकारी को जिस किसी भी डा ने मेडिकल प्रमाण पत्र जारी किया हो वह मेडिकल काउन्सिल के नियमानुसार जारी दस्तावेज है
CAN BANK REJECT A MEDICAL CERTIFICATE ?
मेडिकल प्रमाण पत्र एक विधिक दस्तावेज है , अत: बेंक इसे अमान्य नही कर सकती ,यदि अमान्य करना है तो Indian Medical Council नई दिल्ली को शिकायत करे या प्रथम श्रेणी मजिस्ट्रेट के समकक्ष क्रिमिनल केस दायर करे
Medical certificates are legal documents. Medical practitioners who deliberately issue a false, misleading or inaccurate certificate could face disciplinary action under the Indian Medical Council (Professional Conduct, Etiquette and Ethics), Regulations, 2002. Medical practitioners may also expose themselves to civil or criminal legal action.
WHAT BANK SHOULD DO IN THE MATTER OF DOUBTFUL CASES ----
1) मेडिकल अवकाश , recognized medical practitioner द्वारा जारी किये जाने पर मान्य कहा गया है , बेंक को एक विधिक दस्तावेज को अमान्य करने का कोई अधिकार नही है हाँ un-acceptable आधार पर medical कौंसील मे चेलेंज कर सकती है, इसलिये प्रथम तो बेंक अवकाश स्वीकृत करे या medical कौंसील से निराकरण होते तक लम्बित रखे ,
२) बेंक की मेडिकल अवकाश नियमावली मे कही दर्शित नही है की मेडिकल प्रीस्क्रीप्सन भी प्रस्तुत करना है
SHOULD BANK DISMISS A CSO DESPITE HE /SHE SUBMITTED MEDICAL CERTIFICATE FITNESS & UNFIT BY CHARGING LONG ABSENCE ----
Bank’s action is illegal because CSO has informed the bank regarding medical leave with all supporting documents ,there is proper evidence of ailment so no question of long absence ,more over his medical leave has enough accumulation , maximum bank should refer the matter to medical board but dismissal is unwanted
