Government of India has referred the issues raised by 'United Forum of We Bankers' to National Industrial Tribunal, Mumbai by way of an official notification.
It was submitted today in Allahabad High Court by the ASG of GoI. So, the matter rests there for now.
National Industrial Tribunal has been given a time of 3 months to decide the matter.
I've gone through the order of single judge bench of Allahabad HC in which the GOI's official reference made to industrial tribunal was quoted. Govt's reference is a very limited one which seeks Tribunal to adjudicate the following:
1. Whether IBA's action of not entertaining the demands of UF Webankers, Kanpur was corect or not. If not, what relief Webankers are entitled to.
2. Whether the dispute raised by Webanker can be termed as industrial dispute under ID Act or not.
The advocates of Webankers during the hearing objected to the limited nature of reference made by Govt. To which judge mentioned in the order that since reference is already made, petitioners are free to approach appropriate authority for relief.
Since Govt reference is made, the tribunal will strictly adjudicate on the issues referred to it alone. So, I don't see much is expectd out of this adjudication. Assuming for the sake of convenience, even if both the referred issues are adjudicated in favour of Webankers, how do we expect IBA; which is a puppet of Govt to agree to the demands of Webankers. IBA will say that majority of union members(UFBU) have agreed to a set of revision.

This is not a good news because if u will got to national industrial tribunal for any issue bank will challenge it in high court so the journey to justice will be more long and costly
Earlier high court used to decide issues of bankers like pension so bank couldn't challenge it again but now the road to journey to justice is longer
