I ACCEPT NOW A DAYS INQUIRY OFFICERS ARE NOT IMPARTIAL ,THEY THEMSELVES DECIDE TO PROVE CHARGES ,IN FACT THEY ARE PLAYING THE ROLE OF PO TOO,IN BANKS IT IS TOO DIFFICULT TO GET JUSTICE THROUGH DE JUST BECAUSE SOME COWARDS HAVE BECOME INQUIRY OFFICERS

बेंको में आज की स्थिति में विभागीय जांच के नाम से ,आरोपी अधिकारी को न्याय पाना लगभग असम्भव है ,आरोपी के विरुद्ध जब जांच अधिकारी स्वयम प्रस्तुतकार अधिकारी के रोल में आ जाए तो आरोपी अधिकारी को न्याय कहाँ से मिलेगा ऐसा होने का मुख्य कारण है ,जांच अधिकारी वही बनाये जा रहे हैं जो बेंक प्रबंधन के पिठ्ठू हों और साहसिक निर्णय देने में कमजोर हों

Various friends have asked what is natural justice ,which is the base of inquiry procedure in domestic inquiry, can you explain it in the shortest way. how do you asses the role of inquiry officer in banks?

Friends principle of natural justice & its scope has vast field, though I dealt more than 200 cases as DR still I am not a specialist or say very perfect with the application of natural justice if you are interested in this subject I refer a book written by Mr Tapas Gun Chaudhari a former chief justice ,supreme court of Bangla Desh , I have gone with every chapter of that book so after reading the same “I can say if the disciplinary authority gives every opportunity to charge sheeted to defend his/her case ,this would be natural justice ”DA का आरोपी अधिकारी को बचाव का सम्पूर्ण/प्रत्येक अवसर दिया जाना ही प्राक्रितिक न्याय है.

majority of the disciplinary authority ,makes blunder by denying supply of documents ,guides inquiry officers thus interferes in inquiry ,no response to charge sheeted on his report of bias against inquiry officer , no show cause on penalty proposed, no opportunity of cross examination to mngmt witness, acceptance of charges proved against the charges leveled , clubs 2nd charges during inquiry proceeding ,disallows DR, appoints inquiry officer who conducts preliminary inquiry & so on .

Role of inquiry officer- they don’t play impartial role ,acts as per direction of bank mngt. Almost all inquiry officers play role of totally cowards, he/she himself/herself decides to prove charges that’s why PO’S role become easier, in one inquiry an officer of GM level said he doesn’t know the rules in written statement ,such foolish was conducting inquiry.
