I, wish to invite your kind attention towards the anomaly of date fixed for payment of enhanced amount of gratuity of RS. 20.00lacs to central government employees ie 01.01.2016.
But the effective date for public undertakings has been fixed as 29.03.2018 ie. wef the date of notification of gazette by the government which deprived many employees of the increased gratuity who retired between 01.01.2016 to 29.03.18.
The same injustice was also done earlier when the gratuity was increased from 3.5 lacs to 10.00 wef 01.01.2006 for central governments employees and the date PSBs was 17.05.2010.
It is very disgusting and violation of article 14 of the Constitution of India that employees working in different sectors ie government, private and public are treating discriminately irrespective of the fact that all are governed by the same Gratuity Act.
It needs no amendment in the act but only orders need to be issued to various department to maintain the effective date as 01.01.2006 and 01.01.2016 respectively as in the case of government employees.
I hope that our legitimate demand will be considered favorably.

We are extremely thankful to you for taking necessary steps for the introduction of Gratuity Amendment Bill in the Parliament as well as Rajya Sabha despite hectic pressure and disturbance in the Parliament and for its acceptance and gazette notification without further delay. This kind of gesture has made many employees and officers happy.
2. However, the Amendment with regard to the enhancement of ceiling Gratuity from Rs.10/- lac to Rs.20/- lac has been made effective from 29th March 2018 although there was a continuous appeal from the All India State Bank Officers’ Federation as well as the All India Bank Officers’ Confederation for making the date effect as 1.1.2016 as in the case of the Central Government of employees. We had also sought the help of the Ministry of Labour, the Ministry of Finance to help us out on these counts.
3. The workforce in the banking industry have been in the forefront since the takeover of the NDA Government in implementation of various schemes such as Jan Dhan, Mudra, Atal Pension Yojana, Sukarnya Suraksha, Aadhar linkage and the various other socio economic schemes of the Government during this period. The employees, officers’ fraternity also took the major brunt of handling and successful implementation of demonetization in an effective manner. The Bank employees and Officers’ have taken the major burden of implementing all the schemes of the Government ever since its introduction and were hoping that their superannuation will be improved through the enhancement of gratuity ceiling as in the case of the Central Government employees. They are all disappointed and are looking for your effective intervention so that the benefit of the enhanced gratuity ceiling is available to them from 1.1.2016.
4. We therefore request you to kindly intervene and advise the Ministry of Finance for appropriate administrative directions in this regard so that a large number of employees in banking industry are able to get the benefit of the amendment to the Gratuity Act 1972.
